Terms of Service

By accessing or using the Awathar platform ("Platform"), including the website, mobile applications, and all related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a legally binding agreement between you and Awathar Technologies Pvt. Ltd. ("Awathar", "we", "us").

You must be at least 18 years old and capable of entering into a legally binding agreement to use the Platform. By registering, you represent that all information you provide is accurate and that you will maintain its accuracy. We reserve the right to suspend or terminate accounts that violate these Terms.

To access certain features, you must create an account using your phone number and OTP verification. You are responsible for: • Maintaining the confidentiality of your account credentials • All activities that occur under your account • Notifying us immediately of any unauthorized access We may require additional verification (KYC) for seller accounts and credit facility access.

Awathar provides an online marketplace connecting: • Farmers and agricultural producers • Vendors of seeds, pesticides, fertilizers, and equipment • Commission agents (Aadtiyas) • Wholesale and retail buyers Our services include product listing and discovery, order management, payment processing, logistics coordination, mandi price tracking, expert advisory, community forums, and support.

When you place an order: • You agree to pay the listed price plus applicable taxes, shipping, and fees • All orders are subject to availability and seller confirmation • We reserve the right to cancel orders due to pricing errors, fraud, or stock unavailability • Delivery timelines are estimates and may vary based on location and logistics • Risk of loss transfers to you upon delivery confirmation Payment methods include UPI, debit/credit cards, net banking, wallets, and Cash on Delivery (COD) where available.

As a seller, you agree to: • Provide accurate product descriptions, images, and pricing • Maintain adequate stock for listed products • Ship orders within the committed timeframe • Comply with all applicable laws including FSSAI, GST, and pesticide regulations • Accept returns and process refunds as per our Return Policy Awathar charges a commission on each sale. Payments are released after delivery confirmation, subject to the settlement schedule. We reserve the right to delist products or suspend seller accounts for policy violations.

All payments are processed through secure, PCI-DSS compliant payment gateways. Buyer payments are held in escrow until delivery is confirmed. Seller payouts are processed within 7 business days of delivery confirmation. Credit facility: Eligible users may access credit subject to separate terms. Late payments may attract interest and affect your credit score on the Platform.

• Most items can be returned within 7 days of delivery in original condition • Perishable produce: issues must be reported within 24 hours with photo evidence • Seeds and pesticides: non-returnable once opened/used • Refunds are processed within 3-5 business days to the original payment method • COD refunds are credited to your Awathar wallet Detailed return eligibility and process are outlined in our Return Policy.

You agree NOT to: • List or sell counterfeit, illegal, or banned agricultural products • Manipulate prices, reviews, or ratings • Use the Platform for money laundering or fraudulent activities • Scrape, copy, or reverse-engineer the Platform • Harass, abuse, or threaten other users • Create multiple accounts to circumvent restrictions • Interfere with the Platform's security or operation • Post misleading information on forums or reviews Violation may result in account suspension, legal action, and forfeiture of pending payouts.

All content on the Platform — including logos, text, images, software, and design — is the property of Awathar or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent. Content you post (reviews, forum posts, product listings) remains yours, but you grant Awathar a non-exclusive, royalty-free license to use, display, and distribute it on the Platform.

The Platform is provided "as is" and "as available" without warranties of any kind. We do not guarantee: • Uninterrupted or error-free service • Accuracy of mandi prices or advisory content • Quality of products sold by third-party sellers • That the Platform will meet your specific requirements Awathar acts as a marketplace intermediary and is not a party to transactions between buyers and sellers.

To the maximum extent permitted by law, Awathar and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid to Awathar in the 12 months preceding the claim.

Any disputes arising from these Terms or your use of the Platform shall be: 1. First attempted to be resolved through our Support Center 2. Escalated to mediation if unresolved within 30 days 3. Subject to binding arbitration under the Arbitration and Conciliation Act, 1996 4. Governed by the laws of India, with courts in [City], India having exclusive jurisdiction Buyers and sellers must attempt to resolve transaction disputes through the Platform before pursuing legal action.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Platform after modifications constitutes acceptance of the updated Terms. For significant changes, we will notify registered users via email or in-app notification.

We may suspend or terminate your account at our discretion for violations of these Terms, fraudulent activity, or extended inactivity. You may delete your account at any time through Profile settings or by contacting Support. Upon termination, pending transactions will be completed or cancelled, and applicable refunds will be processed.
